RTC Branch 6 stops CONTI Group from Issuing COGS via 20 days TRO

SUBJECT : 20-Day Temporary Restraining Order (TRO) on PRC Office Order No. 2016-56

Greetings of peace!

We are pleased to inform all PSME Members and Chapter Officers that the Hon. Jansen R. Rodriguez, Presiding Judge of the Manila RTC Branch 6, granted on May 16, 2016, the application for a Temporary Restraining Order (TRO) filed by PSME as represented by the undersigned, effective for 20 days for the nullification of PRC Office Order No. 2016-56 issued by then PRC Acting Chairperson Angeline T. Chua Chiaco. 

The dispositive portion of the court resolution reads:

“Moreover, there is an urgent need to issue a temporary restraining order to prevent irreparable injury to the applicant. This Court agrees that the issuance of the assailed office order has the effect of pre-empting the result or outcome of the judicial disposition of the complaint filed by Conti’s group before RTC- Manila 24 to confirm the validity of the COMELEC Omnibus Resolution proclaiming their group as the winning candidates for the 2016 PSME National Board of Directors.

WHEREFORE, the Court deems it proper to GRANT the application for a temporary restraining order, upon filing of a bond in the amount of fifty thousand pesos (P50,000.00) by the petitioner. For this purpose, petitioner is given a period of five (5) days from receipt hereof. The said temporary restraining order shall be effective for only twenty (20) days from issuance thereof.

In the meantime, this case is set for hearing on the prayer for the issuance of Writ of Preliminary Injunction on May 20, 2016 at 8:30 o’clock in the morning.

Furnish a copy of this resolution to all concerned.

SO ORDERED.”


As such, only the COGS issued and signed by Dr. Murry F. Demdam for purposes of renewal of professional licenses of mechanical engineers shall be accepted by PRC and all its regional offices.
